These Terms of Use ("Terms") govern your access to and use of the website CanadianNewcomerJobs.com and any related services (collectively, the "Website" or "Platform").

2. Nature of the Services
2.1 The Website is an online job-advertising platform that enables:
- Employers and their authorized representatives (including immigration consultants and lawyers) to advertise job opportunities; and
- Job seekers to search and apply for those opportunities directly with Employers.
2.2 The Company is not:
- A government agency or Job Bank;
- An employment or recruitment agency;
- An employer of the candidates listed on the Website;
- An immigration, legal or consulting firm;
- A party to any employment relationship or immigration application.
2.3 Our services are limited to providing an online space for posting and viewing job advertisements and related information. We do not participate in hiring decisions, negotiations, or immigration filings.
3. No Government Affiliation; LMIA & Immigration Disclaimer
3.1 The Website is not affiliated with:
- Immigration, Refugees and Citizenship Canada (IRCC);
- Employment and Social Development Canada (ESDC) / Service Canada;
- Job Bank or any provincial or territorial government;
- Any other governmental or quasi-governmental authority.
3.2 Posting a job or applying for a job through the Website does not:
- Guarantee that an Employer will hire a candidate;
- Guarantee that an LMIA application will be approved;
- Guarantee that a posting satisfies ESDC/Service Canada or Job Bank advertising requirements;
- Guarantee approval of any work permit, visa, or permanent residence application;
- Ensure compliance with federal, provincial, or territorial employment, immigration or human-rights laws.
3.3 Employers, immigration consultants, immigration lawyers and other representatives are solely responsible for:
- Ensuring that job postings comply with all LMIA, Job Bank and advertising requirements, including wages, NOC/TEER classification, duration and content;
- Ensuring compliance with all applicable labour, employment, immigration, privacy and human-rights statutes and regulations;
- Preparing, filing and managing all LMIA and immigration applications.
3.4 The Company does not endorse, verify or certify that any job posting:
- Is LMIA-compliant;
- Will be accepted by Job Bank;
- Meets any specific requirement imposed by ESDC/Service Canada, IRCC or any other authority.
3.5 The Company is not liable for any decision or outcome by ESDC/Service Canada, IRCC, Job Bank, or any other governmental authority, including but not limited to:
- LMIA refusals or revocations;
- Job Bank posting refusals;
- Visa, work permit, or permanent residence refusals;
- Compliance inspections, audits or penalties.
4. Accounts, Security and Access
4.1 To use certain features of the Website, you may be required to create an account and provide information such as your name, email address, password and other details.
4.2 You agree to:
- Provide current, complete and accurate information;
- Maintain and promptly update your information as necessary;
- Keep your login credentials confidential;
- Notify us immediately of any unauthorized use of your account.

"Employer" includes any business, organization, immigration consultant, immigration lawyer or other representative posting jobs on behalf of a client.
Employers and their representatives agree that they will:
- Post only accurate, lawful, and truthful job advertisements;
- Clearly disclose if the position is conditional on LMIA approval or any other regulatory requirement;
- Comply with all applicable employment, immigration, human-rights, privacy and anti-discrimination laws;
- Not charge job seekers illegal or prohibited recruitment fees;
- Respond to applicants in a professional and timely manner where possible.
Employers and their representatives acknowledge that they:
- Are solely responsible for the content and accuracy of their postings and communications;
- Are not employees, agents or partners of the Company;
- Will not represent to job seekers or government authorities that CanadianNewcomerJobs.com guarantees LMIA approval, legal compliance or job placement.
5.2 Job Seekers
Job seekers agree that they will:
- Provide accurate and truthful information in their profiles, resumes and applications;
- Use the Website only for lawful job-search purposes;
- Exercise caution and due diligence before accepting any job offer or sharing personal information.
Job seekers understand that:
- The Company does not endorse or guarantee any specific Employer or job posting;
- It is their responsibility to verify the legitimacy, reputation and terms of any job offer;
- The Company does not charge job seekers to view or apply to jobs and will not request payment for job placement, LMIA approval or immigration services.
6. Prohibited Uses
You agree not to use the Website to:
- Post false, misleading, fraudulent, abusive or discriminatory content;
- Harass, threaten or harm any other User;
- Upload or transmit malware, viruses, or any other harmful code;
- Attempt to access data not intended for you or breach the security of the Website;
- Scrape, harvest, or collect information about Users for unsolicited marketing or other unauthorized purposes;
- Copy, reproduce, modify, distribute or publicly display any content from the Website except as explicitly permitted in these Terms;
- Use the Website for any illegal purpose or in violation of any applicable law.
7. Payments, Fees and Refunds
7.1 Certain services on the Website (such as job-posting packages) may be offered on a paid basis. Prices and features are described on the Website and may change from time to time.
7.2 Payments for paid services are processed via third-party payment processors. The Company does not store full credit card or banking details.
7.3 By purchasing any paid service, you represent that you are authorized to use the payment method provided and agree to pay all fees associated with the service.
7.4 Except as required by law or expressly stated on the Website, all fees are non-refundable, including where:
- You cancel a job posting before its expiry;
- You receive fewer applications than expected;
- Your LMIA, Job Bank posting or immigration application is refused.
8. User Content and License
8.1 "User Content" includes all information you submit, upload, post, or otherwise make available on or through the Website, including job postings, resumes, profiles, messages, logos, and documents.
8.2 By providing User Content, you represent and warrant that:
- You have all necessary rights to share that content; and
- The content is accurate, lawful and does not infringe any third-party rights.
8.3 You grant the Company a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, translate, adapt, publish, display and distribute your User Content in connection with operating and promoting the Website.
8.4 The Company may remove or edit any User Content at any time, without notice, if it believes the content violates these Terms or applicable law, or is otherwise objectionable.
9. Privacy
9.1 Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use and protect personal information.

11.2 The Company does not control and is not responsible for:
- The content, policies, or practices of any third-party website;
- Any loss or damage that may arise from your use of those websites.
11.3 You access third-party websites entirely at your own risk and subject to their own terms and policies.
12. No Professional, Legal or Immigration Advice
12.1 All information on the Website, including resources, blog posts, FAQs and descriptions of programs or processes, is general information only.
12.2 Nothing on the Website constitutes:
- Legal advice;
- Immigration advice;
- Professional advice tailored to your individual situation.
12.3 You should obtain advice directly from a licensed immigration consultant, lawyer or other qualified professional before making decisions that may affect your legal or immigration status.
13. Disclaimers

14. Limitation of Liability
14.1 To the fullest extent permitted by law, the Company, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profits, revenue, data, opportunity or goodwill, arising out of or in connection with:
- Your use of, or inability to use, the Website;
- Any job posting, job offer, employment relationship or termination;
- Any LMIA, Job Bank, visa, work permit or immigration decision;
- Any reliance on information obtained through the Website;
- Any acts or omissions of Employers, job seekers or other third parties.
14.2 To the extent liability cannot be excluded, the total aggregate liability of the Company for all claims arising out of or relating to the Website or these Terms shall not exceed the greater of:
- The amount you paid to us for the relevant paid service in the three (3) months preceding the event giving rise to the claim; or
- One hundred Canadian dollars (CAD $100).
14.3 Some jurisdictions do not allow limitations of liability; in such cases, the above limitation may not apply to you, but will apply to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend and hold harmless the Company and its directors, officers, employees and agents from and against any and all claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:

- Your User Content;
- Your breach of these Terms;
